What Dr. Rugunda Told IGG About Alleged Fraud At NAGRC &DB

Before he was knifed as prime minister, Dr. Ruhakana Rugunda penned a missive to the Inspector General of Government. The purpose of his letter was to investigate, prosecute and terminate contracts for several officials within the National Genetic Resources Center and Data Bank (NAGRC &DB) on allegations of engaging in illegal sale of over 1000 cows and goats on government farms of Ruhengere and Nsharaa.

A disgusted Rugunda according to our Inspectors also wanted the Inspector General of Police Okoth Ochola to use his means and help in this mind boggling saga. This was sometime in 2018 when (now sacked) Charles Lagu was at the whelm of NAGRC& DB as it’s executive director.

Then minister for agriculture animal industry and fisheries Vincent Ssempijja set the ball in motion after he summarily fired Lagu and the then chairman board-Johnson Nkuuhe upon learning that animals were disappearing under unclear circumstances. However, the duo according to what we gathered seemed to enjoy the protection of then state minister for agriculture Joy Kabatsi (at the time). So nasty the scandal was, that the premier directed the IG and IGP to take up the matter which we understood was surfacing for the second time after that of 2015.

Our Field Inspectors quoted the Rugunda letter to have been penned on April 30/2018 and that therein, Rugunda opposed a request for the matter to be probed internally by MAAIF which oversees NAGRC &DB. Ssempijja had proposed this internal probe.

We understood that after Ssempijja fired the ED Charles Lagu and board chairman Johnson Nkuhe, he notified the Premier about his action. Rugunda according to available brief on April 27/2018 summoned a meeting attended by Ssempijja, 1st deputy premier Moses Ali and himself which discussed this embarrassing situation at NAGRC.

“The meeting resolved that the scandal shouldn’t be probed internally but by police” an inspector explained.

As such, Dr. Rugunda in his letter entitled ‘ALLEGED SALE OF COWS FROM RUHENGYERE AND NSHAARA RANCHES BY NAGRC&DB’ asked the IGP to take up the investigation.

Vincent Ssempijja

In a letter dated May17/2018, the premier said his office had received information relating to irregular sale of cows from the two ranches under the NAGRC&DB, an agency under MAAIF.

“This is the second time these allegations are made on this agency. The first time was in 2015 where the executive director was mentioned and in this case, the new executive director is mentioned. The purpose of this letter is to request you to expeditiously investigate the allegations to establish the facts as soon as possible and advise on appropriate action” he said in a letter copied to Ssempijja.

Upon asking the Inspector general of government, this office through the deputy IGG (now chairperson UHRC) Mariam Wangadya, asked the suspects to among other things bring certified copies of their personal files, their recruitment, full minutes, proceedings of a ‘contraversial’ meeting held on April26/2018 and allegedly chaired by Kabatsi. It is this meeting that our Inspectors said watered down the decision by Ssempijja to knife the ED and board chairman. Ssempijja had asked the duo to step aside to allow investigations.

So determined she was to protect the duo, that Kabatsi even penned a letter to the commander of the agricultural police Hillary Odoch to disregard Ssempijja’s directive banning any removal/entry of cows into these ranches until investigations were done.

Such goats went unnoticed prompting Rugunda probe

Her letter was dated May8/2018 and she said that ‘under the instruction of hon. Minister Ssempijja, a temporary halt was instituted not to move any animal from the ranch”

She went on ‘At a NAGRC&DB meeting sitting on April26/2018, it was later established that management followed proper procedures and the cows disposed off were paid for by buyers. The purpose of this letter is to ask you to allow the animals that were disposed off to be taken by these traders to avoid litigation issues to the entity” she said though Odoch paid a deaf ear to her letter according to our Inspectors.

BACK AT MAAIF

Our Inspectors reported that on April 20/2018 Ssempijja summoned the board and ED of NAGRC&DB. The meeting was meant to discuss a crisis in which government cows and goats totaling over 1000 had disappeared from the two ranches. This detail is contained in a dossier authored by one of the Directors of NAGRC&DB Samuel Semanda. It was addressed to Ssempijja and entitled ‘ANORMALIES IN SALE OF GOVERNMENT COWS AND GOATS’. This meeting flopped as the embattled board chair claimed to be on his way to Nairobi on a family commitment. Here, it is claimed the bosses at NAGRC do their thing by way of alleged falsification of documents relating to contracts committee resolutions, under declaration of cash accruing from the animal sales among others.

M7 Deploys Gen. David Kasura

Tired of getting results from NAGRC, inspectors informed us that Museveni tactfully first sent his anti corruption war queen Lt. Col. Edith Nakalema. She met top brass of the ministry including Ssempijja whom she reportedly quizzed on NAGRC mess and also locusts.

From here, Gen. Museveni decided to overhaul the entire leadership at MAAIF and NAGRC. The executive director was put on katebe while the permanent secretary Pius Wakabi was also knifed in public interest. Museveni didn’t stop at that but also shuffled the political leadership of MAAIF.

We are told, Gen. Kasura’s deployment here was meant to mainly study NAGRC and it’s operations. Kasura is a bush war comrade who was among the first intake at the senior command and staff college Kimaka. He was here alongside Gen. Salim Saleh the coordinator of Operation Wealth Creation. Others were David Tinyefuza, Ivan Koreta, Col. Sula Semakula among others totaling 31 officers. Kasura according to Inspectors in state house had excelled in putting NALI on form, the reason he came to MAAIF. We are told the reason Museveni has been hesitant to make NAGRC autonomous from MAAIF is partly because of alleged negative results.

Museveni’s Continued Closure Of Schools Is In Bad Faith

Ishaa Otto Amiza

In the latest , address by President Yoweri Kaguta Museveni every well meaning citizen of Uganda expected the opening of School for both learners, pupils and students in Secondary, Tertiary Institutions and Universities but there was nothing.

Museveni has used COVID-19 pandemic to suffocate economy and many strategic sectors like education, religion and political meetings to allow him remain the only dominant person.

Besides the lockdown, while President Museveni locked down the rest he has continued to do his politics through RDCs,DISOs and Operatives who are funded by monies generated from donations and allocated funds meant for fighting the scourage of COVID-19 pandemic.

It’s regrettable that the fate and future of thousands of pupils, students and private teachers caught up in this lockdown remains in a mess without any remedy to reclaim.

For Museveni to open up Markets, Public Transport and Churches ,where pupils and students go to freely and pretend to be protecting students from COVID-19 is a fallacy and self deception which is unacceptable.
UPC encourages families and teachers within their vicinity to engage in home schooling as a remedy to maintain the minds of the students towards education.

Government of Uganda should now be prepared to compensate the time lost by both students and parents due to illegal and unnecessary lockdown imposed on education in the Country.

The continued closure of schools is also an indicator that government has no capacity to handle the health needs of students, no wonder , President Museveni and the Ministry for Education failed to provide the needed and pledged sanitary pads for girl child.

It’s now on record that many Countries in the World including, Rwanda, Kenya, Nigeria, etc have continued to maintain schools besides the scourage of COVID-19 pandemic by enforcing SOPs just like it’s being done in other institutions.

The effect of keeping pupils/ students longer at homes particularly the adolescent girl child will have a permanent scar on the physical and psychological growth and future of the girl child.

The children who got pregnant during the lockdown should be unconditionally allowed to continue with their studies.
Government should not forget that it’s the Constitutional duty of the State to educate the child and hence denial of education to children on the weakness to manage health risks related to COVID-19 pandemic is unconstitutional and can be challenged.
Schools can easily open on strict adherence to the Standard Operations Procedures( SOPs).

Socialite Judith heard bashed for serving ‘bean-less’ Sumbie

A few years ago socialite Nalongo Judith heard became an internet sensation after pictures of her displaying a ‘bean’ that nearly dwarfs Lwasa’s ‘big pimple’ leaked to the public.

After heated social media frenzy, Ugandans quickly moved on, especially given that Heard was not the first to do so as we had seen other intimate endowments of the likes of Zuena, Cindy, among others.

But like they say, old habits die hard. Nalongo Heard is back on the rumor mill after a new cache of her nudes and videos leaked. In a statement she released moments after the leakage of the raunchy photos and videos, the former model blamed the leak on hackers who went into her twitter handle after she lost her phone.

However, not many Ugandans bought her explanation, with many social media moralists believing she is pulling a stunt to create relevance in this Covid-hit banana republic.

“We shall not fall for your gimmicks. You must have leaked your nudes to get a comeback since you’re faded,” commented one Facebook user. Another one remarked, “It’s okay to lose your phone but why take nude videos and photos in the first place?” it remains to be seen how Heard will wade through the second wave of his nudes; although this time they were served with less show of beans!

Drama as M7 men clash over NUP, MP Ssewanyana ‘Kidnap’

NBS TV’’s The Frontline took a dramatically hot twist last night when President Museveni apologist Andrew Mwenda and Information Minister Baryomunsi clashed over the government’s handling of opposition party NUP. Specifically, the two Museveni men disagreed over government’s linkage of NUP to the recent bijambiya murders in Masaka which culminated into the arrest of NUP legislators Allan Aloysious Ssewanyana and Kawempe North’s Muhammad Ssegirinya.

The clash followed news of the re-arrest of MP Ssewanyana by security operatives moments after he had been released from kigo prisons. The MP’s re-arrest was confirmed by his lawyer Erias Lukwago who took to his facebook wall to reveal; “Horrible!!!…Hon. Allan Ssewanyana has been kidnapped at gunpoint at the entrance of Kigo prisons by gun-trotting operatives shortly after his release by prisons authorities. He has been whisked away in a drone to an unknown destination, rendering the court order nugatory,”

The news seemed to have irked Mwenda, who then tore into NRM, likening it to past regimes like obote’s, which the NRM has perennially accused of perpetuating injustices and human rights abuses against ugandans thus even leading to the popular NRA 5-year guerilla war. “Right now you’re behaving like Obote that you criticize. An MP is an important person who can’t run anywhere. Why don’t you first collect information and then arrest?” Mwenda said. Mwenda’s concern seemed to have been evoked by the ensuing rumors in which the general public quickly spread word that the MP had been kidnapped by unidentified gunman and whisked away in a drone.

This rumor was however only quelled after the Uganda People’s Defence Forces (UPDF) came out to won the said Kayihura-style operation and also confirmed having the MP in their custody.

“We have him and he has not been kidnapped as some people are writing. He is safe but will have to answer some more questions,” the UPDF Spokesperson said.

However, despite Mwenda and some other Ugandans’ concern, an unapologetic Baryomunsi defended government actions, assuring Mwenda that granting one bail is no guarantee against re-arrest.

“Granting you bail doesn’t mean you can’t be rearrested. Maybe during the bail application more information came out. The only thing we are against is him being tortured. He can be arraigned again in court,” Baryomunsi said.

Commenting on the Masaka Bijambiya murders, Mwenda poked holes in government’s insistence that NUP was behind the chaos as well as the glaring lapses in handling the matter. “The government is accusing NUP of spearheading the murders in Masaka. If the man is guilty it is better to leave him so that you can monitor him and tap his phones to collect more evidence,” Baryomunsi said.

Mwenda’s remarks came on the backdrop of widespread public opinion that the murders could have been instigated by government as a cover to decimate or possibly settle political scores with NUP which garnered over 70% of the presidential vote in the last general elections. However, government has vehemently denied such a narrative.

In fact, hinting on this same issue, Baryomunsi replied; “we have not said NUP is responsible for the murders. If we were going after NUP leaders, Allan Ssewanyana and Muhammad Ssegirinya are not the biggest in NUP.”

Ssewanyana’s re-arrest means the NUP MPs will spend more time in the coolers despite the high court having given them cash bail of shs20m each on September 20, 2021.

The legislators’ lawyers decried that the state resorted to playing delaying tactics with the suspects’ files thus preventing their release. It is upon this that they applied for their release through court, which was granted on September 23. However, Ssegirinya could not leave prison due to absence of his surety Francis Zaake while Ssewanyana was rearrested immediately after release.

What’s In Stock For Gen. Muhoozi Camp Ahead of 2026?THE INSIDE STORY!

Lt. Gen. Muhoozi Kainerugaba’s legal camp is reported to be combing all libraries to have a supersonic move on how to navigate the impending constitutional crisis if the country abolishes the Presidential Elections Act.

This Act, empowers Ugandans to elect their president in a democratic manner but under the proposed arrangement, this may change. In the new project as we reported recently, the plotters want the MPs to elect the president in what is being termed as ‘Parliamentary democracy’Here, the party that will martial majority seats, will form government and also elect a president. However, as this proposal takes shape, another hurdle has been detected which those backing Muhoozi within NRM are trying to scratch their heads on how to legally disentangle it.

Bobi Wine

The puzzle is on the position of executive prime minister and president which the proposed constitutional order is likely to introduce if copied wholly from the Westminster.READ ONHe may have not yet declared his intentions to stand for president in 2026.

However, the commander of land forces Lt. Gen. Muhoozi Kainerugaba is currently in the news with suggestions that he’s being favored by the ruling party NRM to succeed his dad. With this agitation gaining momentum within the political circles, it has come to our attention that the agitators are mooting a double face amendment to the law.

It should be recalled that recently we told you of how some circles within the establishment were mooting a proposal to have what was described as a ‘silent coup’ within NRM (but with the knowledge of Gen. Museveni) to aid the first son ascend to the party’s top leadership. Here, Muhoozi according to the plan; is supposed to retire from the forces and stand for a position in the NRM so that he tactfully challenges his dad for chairmanship of the ruling party.

Odrek Rwabogo

In the meantime, he is also supposed to stand for MP seat in 2026 or in any by-election that may come later. And because there’s a proposal by the same agitators to amend the national constitution to move away from the current presidential elections Act to a parliamentary system of democracy, Muhoozi; in case he wins, will join parliament where it is expected that NRM will have majority seats in 2026.

Therefore, when it gets majority, it’s chairman (read Muhoozi) will automatically become the NRM favorite for president and this is how the battle-hardened Lt. Gen. MK will succeed his dad. (Refer to our story-MUSEVENI TRANSITION TAKES SHAPE IN NRM)

However, inspectors within what is now refered to as ‘MK’ camp suggested that whereas they want to adopt the Westminster model to aid Muhoozi presidency without much hurdles in 2026, the challenge it presents is the issue of having an executive prime minister instead of president.

“This means we have to modify further the amendment. We want MK to be the head of state at the same time the president but not giving the powers to the prime minister” says an inspector knowledgeable on the alleged MK deal.In the amendment, it is being argued that whereas the independence constitution of Uganda presented a ceremonial president and an executive prime minister, the plotters within NRM want to pursue the Milton Obote approach which finally fused the two positions and he became the president.”For us we believe the Head of State is the embodiment of the country’s sovereignity. President can be elected but a head of state doesn’t necessarily need to be elected. We are now saying we need these powers to be with the president” an inspector explained.

According to the plotters, the 1962 constitution brought a contradiction because it was set on a ‘contradiction’. It was explained that the movers of that constitution copied it wholly from UK where there is a national monarchy and yet in Uganda there is no such a national king.

President Museveni

“In UK it’s the queen who invites the winning party to form government. King Muteesa (Buganda) didn’t foresee this before accepting to become president of Uganda” an inspector added. The inspector explained that if Sir. Edward Muteesa foresaw this and he wanted to become a national king, he needed to have conquered other regions of Uganda or he needed to have sweet-talked them to accept him as a king of Uganda.”

Therefore, if we are to refer to the independence model, we have to modify it so that we have a head of state and a president under one person like Obote did. He toppled the president (who by all means was ceremonial) and grabbed those powers.

So, even as we want to introduce the UK model to propel Gen. MK to presidency, he must as well be a head of state. The prime minister should serve under him the way his dad is doing” an inspector said adding that they want the chief justice to swear Muhoozi in as president/head of state signifying that he has executive powers and not prime minister.

Muhoozi has risen through the ranks to become the CLF having served in various capacities in the army including but not limited to nurturing the Special Forces Command; an elite force within the UPDF. He’s now within the mainstream UPDF as CLF and was last seen in the trenches of Masaka region hunting for bijambiya criminals. Recently, he asked his dad and CiC Gen. Museveni for permission to go Guinea and depose the military junta that toppled president Alpha Conde.

He’s currently also serving as a SPA/SO alongside his military role as CLF.Besides known opposition NUP principal Robert Kyagulanyi alias Bobi Wine, Gen. MK may have to face his brother in law Odrek Rwabogo whom some sections within NRM are fronting as a suitable successor to his father in law Museveni.

NWSC Embarks On Aguru Water Project, Blames Water Crisis In Tororo On Mudslides In Manafwa

In an effort to end acute water crisis in certain parts of Tororo district, National Water and Sewerage Corporation has embarked on the Aguru Reservoir project.
This was revealed by the NWSC board chairman Dr. Eng. Badru Kiggundu who led a team of water engineers from NWSC to undertake a fact finding mission in the district. The team met with area leaders including RDC Nixon Owole and LC5 chairman John Okea and that they discussed water and sanitation in this area.

The team was informed that there is water scarcity in some parts of the district especially at Aguru. Here, it was reported that a jerrican of water goes for shs1000 instead of the Sh25. The local leaders described the situation here as frustrating and absurd but Dr. Kiggundu promised that soon, things will be better.

“The situation is bound to change, sooner than later. The Tororo area team has already embarked on the Aguru Reservior project with trenching already ongoing and very soon, water will be flowing in the area” Eng. Kiggundu said.

Silver Mugisha

The RDC commended NWSC’s commitment to service in the area especially within the town but however, noted that outside the town services are lacking.
“In town, we have no problem at all. We do however hope that the people outside town can be catered for as well”, he stated, adding that he was happy with NWSC staff for being responsive, cooperative and dedicated.
Meanwhile, the deputy managing director-Technical services Eng. Johnson Amayo assured people of Tororo that NWSC was doing all it takes to ensure steady water supply in the district.

“We are aware of the issues in Tororo and we are doing everything in our power to ensure supply in this cluster”,

Eng. Amayo said.

He apologized on behalf of NWSC for the frustrations that may have been caused but however, attributed it to mudslides. He explained that the Water Plant in Manafwa was destroyed by the mudslides, but has now been reactivated.

“Very soon, some relief will come to the greater Tororo. The various ongoing projects are bound to resolve the water supply trials in Tororo cluster and the greater Eastern Region. We are not going to fold our hands. We have a supportive B.O.D, and we shall see to it that all is resolved”, .

he pledged

The LC5, Hon. Okea commended the B.O.D for their contribution towards access to clean safe water in greater Tororo but requested that NWSC needs to bend the rules against drilling boreholes.
This he said concerns the dry zone in the cluster.

“Kindly make an exception for us. You can limit us to a particular number of boreholes, but make the exception”,

he urged.

He also requested NWSC to consider connecting Tororo to Lake Victoria via Busia and Majanja citing the challenges facing the Manafwa line and the current intake source in Tororo which he said is small and has compelled rationing, something insufficient for the people in Tororo.

Eng. Amayo however, clarified that the corporation has no law against drilling personal boreholes but rather regulates the process.
“We have adopted a mixed model approach so that people can get the service they need”, he stressed but however, warned that such boreholes maybe disastrous if missused. He cited a situation that occured in some parts of Northern Uganda when typhoid was an epidemic. He therefore, cautioned the LC5 against looking to boreholes as a solution especially in a town as vast as Tororo.

Johnson Amayo

“As you advocate for boreholes, assess it and understand the downsides”, Eng. Amayo said and added that the Lake Victoria option be put on hold until the current water source has properly been utilized.

The RDC informed the team that in an effort to tackle vandalism of NWSC properties especially in parts of Namisindwa, a task force had been put in place and was already cracking down on the vandals who he believes will be stopped at every cost.

The meeting was concluded with a call for NWSC to intervene in the waste disposal in Malaba, an issue that many officials have complained about especially on the Kenyan side. So the hope is that the Ugandan side can go ahead of the Kenyans and pilot wastewater projects in the area.

To this, Eng. Amayo promised that the NWSC team would look into it but also urged the LC5 to prioritize identifying land for a sewerage treatment plant that can cater to wastewater in the greater Tororo cluster.

“We all have a common goal. To make Uganda the best place for Ugandans and those that visit. So I hope we can work together to fulfil our promises to the people and better their livelihoods”, concluded Eng. Kigunddu.

Shocking secrets As Custodian Board Boss Bizibu speaks out on 800-Acre Land Saga

Departed Asian Properties Custodian Board (DAPCB) Executive secretary George William Bizibu has revealed shocking secrets regarding accusations of trying to sell over 800 acres of government land to ghost claimants.

Bizibu revealed the secrets while responding to our August 30, 2021 article titled “Custodian Board Boss Bizibu In Trouble As Minister Kasaija, IGG Kamya Unearth 800-Acre Land Theft”. In the said report, we revealed how a whistleblower report to the Inspector General of Government (IGG) pinned Bizibu and his junior Irene Apio Julu on ‘erroneously’ signing two consent agreements with two ‘ghost claimants’ of the land designated as Kayunga estate and comprised in Kyaggwe Block 45, Plots 21, 22 and 26 at Ntunda, Mukono district.

The purported ghost claimants were identified as Kayongo Moses Byanguye and Sarah Nakato Kiwumulo. As per the consents, the pair was purported to have relinquished 300 acres near Ntunda Trading centre to government upon which they would be sold the remaining 500 acres under private treaty. It is said that the agreements followed a court battle where the claimants were protesting being dispossessed of the same land by the Custodian Board.

Nothing Fishy
But responding to the claims, DAPCB Executive Secretary Bizibu revealed that all the processes pertaining to this particular land were done following well-laid statutory due process and with the blessing of the DAPCB board led by the Finance Minister, Matia Kasaija.

ADVISED CUSTODIAN BOARD_ Minister Kasaija

He however regrets that the process has been mired in deliberate misrepresentations by his probable detractors who may be motivated by their personal interest or at worst, ‘work politics’. Explaining his own account of the events, Bizibu explains the whole matter as hereunder:

Genesis
Bizibu explains that the mandate of the DAPCB is to manage the properties (and businesses) that were taken by government from Asians that departed Uganda following the expulsion of Asians by President Idi Amin in 1973. However, one of the perennial challenges facing DAPCB since its inception by the Assets of Departed Asians act of 1973 has been proper documentation, most especially the lack of a clear assets register of these properties. Bizibu noted that having inherited this challenge when he took office, he embarked on a mission to investigate, research and locate these properties. “We have had to comb university libraries and other sources to unearth this information because it was not readily available within the government structures,” Bizibu said.

It should be noted that in a recent report into the affairs of DAPCB, the Auditor General John Muwanga revealed that Bizibu reported to his supreme audit institution (SAI) that (through such research efforts), DAPCB has since compiled an assets register for these properties. The register currently reports that 4,063 properties have since been repossessed by returned Asians. 1676 properties were sold by government while 3226 remain unsold.

Enter Kayunga Estate
Bizibu noted that while the Kayunga Estate land fell within the DAPCB’s mandate, it was unknown to government. However, through the above efforts, the DAPCB research team unearthed it in 2018, it was discovered in 2018. This was when it was reported to the board’s Divestiture Committee, thus kicking off an effort to reclaim it for government.
To confirm its physical existence, a three-man Divestiture Committee members’ team visited the land. These officers were; Byakatonda Abdulhu (chairman), Irene Apio Julu and Clement Kandole.

REFUSED TO SIGN_ Dr.-Byakatonda Abdulhu

On October 1, 2018, Byakatonda notified the police about this matter, and also alerted it to the fact that the land was being illegally occupied by unscrupulous people including one Kyeswa Godfrey and Uganda Farmers Crop Industries Limited. At that time Kyeswa was even operating a sugarcane growing and sugar milling (Kayanja Sugar Factory) business on 300 acres of this land and had even secured titles for the land from Mukono District Land Board.

It however later emerged that two people identified as Sarah Nakato Kiwumulo and Moses Kayongo Byanguye were laying claim to the same land. Police was thus urged to investigate the matter and come up with recommendations.
But having confirmed the existence of the land, the DAPCB Divestiture Committee on January 2, 2019 authored a report recommending that the said land be allocated to Kiwumulo and Byanguye who would however pay government Shs2m per month for using the land.

Indeed, on January 7, 2019, this allocation was done and the two allocates began paying the said rent to Bank of Uganda’s divestiture account.
The DAPCB got a boost when on February 19, 2020. Police outed its report whose findings showed that Mukono DLB erroneously issued titles to Kyeswa and Uganda Farmers Crop Industries and so these had to be cancelled.
Consequently, on February 27, 2020 DAPCB began this cancellation process when its divestiture committee wrote the Commissioner Land Registration to cancel the said titles.

Following a series of investigations, on July 24, 2020 the ministry of lands called the concerned stakeholders to this land for a public hearing in respect to this cancellation. This cancellation would subsequently be issued by Francis Banumba on September 11, 2020.

Following the cancelation, on October 19, 2020, the DAPCB divestiture committee delegation comprising chairperson Abdulhu Byakatonda, Irene Julu and Hirome Mayanja Sabehe went and handed over the said land to Kayongo and Kiwumulo. The handover was witnessed by the allocates’ lawyer David Henry Mukiibi, the area LC1 boss Edward Mukalazi, Abraham Bosingo Lubega and Detective Corporal Oluka Tom, the in-charge Land desk at Naggalama Police Division.

Handover U-turn Sparks Off Wars

One of the contentious issues that have seen Bizibu dragged into trouble is the allegation of signing two separate consent agreements with the allocatees for possible self-interest.
However, Bizibu explains that this was necessitated by the unscrupulous conduct of two members of the divestiture committee and was done to protect DAPCB against legal liability following guidance by the minister of finance.

He explains that two weeks after the above handover of the land to Kiwumulo and Kayongo, divestiture committee members Hirome and Byakatonda showed displeasure with the handover of the said land to the allocatees. “This was despite the fact that they both attended the handover and even consented to it,” Bizibu says. He adds that the pair vouched for the interests of Kyeswa, opining that he deserved to be allocated the land since he had established on it a mega project which was even launched by President Museveni.

The Suits, Two Consents

On getting wind of the plot to dispossess them of this property, Kiwumulo and Kayongo protested, thus dragging DAPCB to court.
It was at this juncture that Bizibu as the DAPCB accounting officer sought Minister Kasaija’s advice. As DAPCB supervisor (since he’s the chairman of the DAPCB BOD), Kasaija counseled that a middle ground be found so as to accommodate interests of all occupants on the land including Kyeswa. He however cautioned that Kyeswa had to be tasked to first compensate the government for what he had accrued from the land as an illegal occupant.

For this allocation to be done, the land had to be surveyed and properly documented.
The survey was conducted, led by two surveyors namely Lutaya of Entebbe lands & surveys and Agaba, a senior surveyor from the ministry of lands. It was witnessed by Irene Apio Julu on behalf of DAPCB and Bizibu revealed that he sent Julu to witness this exercise by virtue of her seniority and institutional memory of DAPCB matters having worked for the entity since 1989. The survey showed that the land measured 815 acres but Kyeswa had encroached on only 300 acres of it, with the 515 lying idle.

With the survey done, a consent agreement was undertaken before Justice David Batema of Mukono High court vide Civil Suit No. 202 of 2020. It was between the plaintiffs (Kiwumulo and Kayongo) who were represented by their lawyer Mukiibi David Henry and the defendants (DAPCB, Byakatonda Abdulhu, Hirome Sabehe, Irene Julu, Nyangoma Grace Everce and Ibrahim Kasozi Biribawa). As per terms of the consent, Kyeswa would be left with the 300 acres upon fulfilling the minister’s conditions. Meanwhile, 15 acres were to be consumed by roads and reserves and the allocatees would take the remaining 500 acres which were to be sold to them under private treaty.

Bizibu revealed that despite all members of DAPCB being involved in this matter to this point, Byakatonda, Hirome and Counsel Wandera Ogallo refused to sign the consent agreement. In a report before the IGG, the officers claim that their refusal was due to queries they had about the existence and identities of the plaintiffs (Kayongo and Kiwumulo).

Particularly they claimed they had never seen them; although there was availability of the pair’s identity cards. And that the two officials’ curiosity was further raised after remote searches of these IDs did not yield results. It was thus thought that Bizibu could have fronted fake people for reasons best known to him.
Bizibu however revealed that this was a false accusation since these officers had physically handed over the land to the said ‘ghosts’.
It is thus thought that the refusal had a bearing with an attempt to advance Kyeswa’s interests.

Second Consent Agreement Comes In

Bizibu says that following this deadlock, he sought the guidance of the solicitor general, who advised him to ensure that he takes a decision that protects DAPCB (government) from liability. It is then that he and Julu as well as other members of the divestiture committee opted to draft another consent which was signed in the interest of protecting government interests.
Bizibu says he resorted to this action after even when the lawyers of the assumed ghost allocatees physically produced them before the Hiromes, they still insisted that they were fake. Secondly, the purported second consent was approved by the DAPCB Board, which is the supreme supervising body as well as the entity’s lawyers of Victoria Advocates and Legal Consultants.

In a bid to address challenges of shortage of medical equipment used in the intensive care Unit, the Medical Research Council and Uganda Virus Research Institute have donated oxygen cylinders with regulators and accessories, patient monitors, and beds with mattresses and drip stands worth Shs250,771466 to save lives of COVID-19 patients, especially those in critical health condition.

While receiving the donated medical equipment at Entebbe General Referral hospital, Dr. Moses Muwanga, the hospital Medical superintendent, said the donated equipment has come at a time when the hospital is constrained with inadequate Oxygen support equipment which saw some COVID-19 patients passed on during the second wave of the lockdown.

“We signed a memorandum of Understanding (MOU) with Uganda Virus Research Institute to offer us clinical care and research. During the second wave we lost some COVID-19 patients in critical condition and the major challenge was lack of an oxygen cylinder.

Dr. Muwanga adds the equipment would help management of the hospital to handle Covid-19 patients during the impending third wave Covid-19.

“It’s worthy to note that the first covid-19 patient was treated at Entebbe Referral hospital and we hope the equipment we have received today will be handy in case there is a third wave.

Dr. Felix Magala, who is in charge of Oxygen support equipment at Entebbe Hospital, said there is need for a large oxygen plant at the health facility to handle the expected big number of Covid-19 patients during the impending third wave. “The donated equipment will offer additional care to patients, especially those whose lives require oxygen support.

Dr. Jonas Lexow, the Chief Operating officer at Medical Research Council/Uganda Virus Institute, said they have had a successful partnership with Entebbe General Referral hospital and that the Medical Research Council is committed to donating more equipment to the health facility.

“We shall continue lobbying for funds from the UK Medical Research council and London school of Hygiene and Tropical Medical.

UHRC Boss Irked By Increased Torture Of Journalists

By Sadique Bamwita

The Acting chairperson of Uganda Human Rights Commission (UHRC) has expressed dismay on persistent attacks on the mainstream media in Uganda saying this hampers freedom of expression.

Addressing participants (Journalists) during a capacity building training on Human Rights Based Journalism, Meddie Mulumba, the Acting chairperson Uganda Human Rights Commission (UHRC), said due to increased attacks on journalists by security agencies, the Human rights body thought it wise to train journalists to understand their fundamental rights and freedoms.

“The critical role of the media in human rights can’t be over emphasized. The media can enforce democratic governance in achievement of vision 2040. Indeed, mainstream media is under serious attack,” he said.

He also noted that freedom, and human rights go hand in hand and urged all media practitioners to enjoy their fundamental rights and freedoms.

He further asked journalists to avoid being partisan and always report cases of torture inflicted on them to the Uganda Human Rights Commission.

“We intend to train security agencies on how to handle journalists and all journalists who are victims of torture should be compensated”.

Kamadi Byonabye, the Director Regional Services at UHRC, noted that between 1962 and 1986, Uganda had a number of part time presidents and during their tenures in office there were a lot of human rights violations.

“In the past regimes human rights violation was orchestrated with a lot of impunity for instance soldiers would rape women and go unpunished. During these regimes there was no respect for human rights and freedom.”

Kamadi, however, revealed that there are matters over which the Human rights body has no jurisdiction, especially matters pending before another court or matters involving relations or dealings between government and a foreign government.

Juliet Logose, a director at UHRC, reminded the state, duty bearers and security agencies to desist from gross violations of human rights and humanitarian Law.

Rosemary Kemigisa, a senior human rights officer at UHRC, cited threats or drastic measures against media houses plus poor remuneration of media practitioners as some of the key issues affecting the media industry.

Dr. Adolf Mbaine, who lectures in the department of Journalism and communication at Makerere University, cautioned journalists against plagiarism in addition to avoiding payments/ cash for news or brown envelope journalism.

Ida Nakiganda, the Director complaints, investigations and legal services at Uganda Human Rights Commission (UHRC), revealed that the commission faces some challenges which hamper prosecution of human rights violators. For instance, failure to follow up complaints registered with the human rights commission and failure to provide key documentary evidence such as medical reports.

Some of the journalists who participated in the capacity building training on Human Rights Based Journalism commended the Human rights body for enlightening them on their fundamental rights and freedoms.

UWA Criminal Staff, ‘Cyber Dinosaurs’ Aiding Poachers — AWF Boss

By Sadique Bamwita

The Country Director of African Wildlife Foundation (AWF) has poked holes in Uganda Wildlife Authority (UWA)’s ‘Operation Fata Poacher’, saying it lacks the ability to net wildlife cybercrimes.

Suudi Bamulesewa, revealed that for all its noble intentions, the operation aimed at eliminating poaching of Uganda’s wildlife lacks robust capacities to outsmart poaching approaches that are coordinated online. This, Bamulesewa said, is due to the fact that UWA officials can’t adequately analyze gadgets seized from poachers or wildlife encroachers; hence causing delays in prosecuting poachers.

Bamulesewa made the remarks while speaking to the media in Entebbe on Wildlife Judicial and prosecutorial support on operation Fata Poacher.

“Can you imagine UWA, which is a leader in conservation of wildlife and prosecuting suspects, doesn’t have the capacity to analyze gadgets confiscated from suspects! The police they use prefer to work on its own cases thus delaying dispensation of justice,” he said.

Bamulesewa cited limited finance as one of the obstacles in conducting Fata Poacher operations and called on for more funding.

Bamulesewa asked the Uganda Wildlife Authority to involve communities around national parks in its effort to stamp out wildlife cybercrimes.

“It’s useless to coerce the community but there is a need to involve it in our operations. Many community members lose their crops especially when elephants escape from the game parks.”

Ernest Angina Ochieng, the manager in charge of cybercrimes at the African Wildlife Foundation (AWF), asked all stakeholders to step up efforts in fighting wildlife crimes so as to bring the perpetrators to book.

“High prosecution of poachers or wildlife encroachers would certainly reduce criminals.”

Joshua Karamagi, the manager in charge of Investigations at Uganda Wildlife Authority (UWA), said during the Fata Poacher operations, it was discovered some UWA staff were involved in wildlife crimes.

“We conducted an investigation on our staff and it yielded good results as some of our personnel were implicated in the malpractices.

We instituted thorough investigations and those found guilty will be axed. ”

Karamagi revealed that during operation Fata poacher they managed to apprehend 32 supsects, 3 of them convicted while the rest are still on remand awaiting court determination on charges imposed on them.
